All About Collection Appeals

Your IRS problems have accelerated from an IRS notice, to an audit, to a collection appeals hearing. You have every right to ask for an appeal if you don't agree with an IRS decision. When the IRS receives your appeal, it knows that you disagree with its decision and that you'd want to arrange a meeting to discuss ways to settle the dispute.

Appeals may be filed against:

  • Rejected offers in compromise and terminations of installment agreements
  • IRS liens, levies, and seizures
  • Penalties and interest
  • Trust fund recovery penalties and employment tax adjustments

Depending on what you are appealing, there are a lot of guidelines and timeframes that should be followed with collection appeals. File the collection appeal the right way and in a timely manner with the specific information.

If you don't wish to lose your chance at an appeal by filing it late and erroneously, request a collection appeals hearing as soon as possible, especially if the IRS increased your tax bill by adding penalties and interest.

You have every right to file a tax debt collection appeal if you've been served notice of an IRS levy or seizure, whether verbal or written. You can file this appeal before the IRS actually enforces the levy or seizure.

Filing a Collection Appeal the Right Way

Explain why you are disputing the IRS decision and suggest a settlement on the collection appeal form. A decision will be made by the appeals officer assigned to your case within five days.

Your Expectations

Your appeal might be resolved by phone or correspondence. If this isn't possible and a hearing is set, you may choose to represent yourself, but you're at liberty to bring representation to assist you. Collection appeal hearings are normally informal.
